World AIDS day has been held December 1st of each year since 2007. There are more than 343 warriors from over 22 countries who will take part in the activities on December 1st. They will not eat any food for 24 hours to support the cause of China’s prevention and control of HIV/AIDS.

 

On December 1st, 2012, world AIDS day, the sixth annual Hunger Strike for AIDS is about to begin. The theme is “expanding AIDS rights, protection of accessibility”. We want more people to pay attention to the importance of legal services to people affected by HIV/AIDS. We hope to eliminate people’s discrimination to people infected with HIV and AIDS patients, and to build the importance of social peace. We also expect to obtain donations to support the AIBO Relief Law Program, especially to open a 400 number phone line. And we hope to obtain donations of legal fees for people living with HIV who suffered injustice.

 

Take the AIBO Relief Law Program as an example. The program provides three hotlines staffed by three professional lawyers. The aim of the Program is to provide professional legal counseling and aid to people affected by HIV, and guide them to safeguard their lawful rights through legal ways. This will promote AIDS anti-discrimination and the justice of society. From December 2010 to June 2012, there have been 119 cases of legal counseling from more than 20 provinces and autonomous regions. Some calls even came from lawyers, seeking counseling on how to obtain evidence when someone affected by HIV was refused by a hospital and regarding the cause of death, regarding which problems should be paid attention to in the lawsuit and so forth.

 

In the first half year of 2011, there were 43 cases legal counseling and 37 cases in the next half year. In the first year of 2012, there were 39 cases. Those numbers break down into the following details; 15 cases were regarding compensation because they were infected by HIV through blood transfusion and the courts have done nothing about them; there were 11 cases called regarding compensation because they are infected by HIV through blood transfusion or blood donation; there were 10 cases for counseling about the privacy tort and privacy blackmail; 10 cases regarding divorce of people infected by HIV and about raising children; 10 cases about employment discrimination and other employment problems; 7 cases about medical discrimination and other medical problems; 8 cases about life assistance6 cases about medical assistance; 2 cases about implementation of the assistance policy; 6 cases where a person thought that another person transmitted HIV to him/her through sex, so the call regarded whether the person shall be investigated for legal responsibility; 3 cases about discrimination in commercial insurance clauses; 7 cases about the forced detection of HIV, or about real-name detection, or regarding the willful withholding of the results after the detection, so the caller inquired about compensation; 2 cases about psychological problems; 7 other cases involving with the people living with HIV; another 22 cases have nothing to do with people living with HIV.

 

In support of ILO (Beijing office), the AIDS Relief Law Project originated on December 10, 2010, on the World Human Rights Day. The AIDS Relief Law Project aims to service the law and human rights work of people with HIV, to promote the implementation of International AIDS and human rights in China and the domestic law of AIDS policy. The main work is to: provide three different hotlines for legal consultation, provide legal aid for typical cases, carry out legal training and seminars about AIDS for judges, lawyers and leaders of communities, to develop law and policy research about AIDS, to advocate for relevant laws and policy involved with AIDS events, and so forth.

This is also a kind of support to us to expand AIDS rights and the protection of access for persons with HIV!
