A public letter to "National Endowment for Democracy"

NED and Dear Leah Flynn:

Thank you very much for NED support for the China HIV/AIDS  CBO  Network . Lately, lots of things happened within the conference, which we believe it is necessary to tell you the truth.

On 28th Dec,2013, in Wuhan, the new term of China HIV/AIDS  CBO  Network  Council made the decision of electing the new term of the Secretariat, which was against the rules of the Conference and disrespected the regulations. Until now 26 China HIV/AIDS  CBO  Network Members have signed to refuse taking the result of the election of He Shengnan, the Leader of Henan public welfare pioneer group , as the Secretary of the Committee.

 

According to the rules of the committee, secretariat is elected by the Committee and the Conference council has no right to do that and the former 8 terms were all followed the rules and elected by the Committee.

Besides, the election of the Conference Council in Wuhan Province is also very controversial. 51 members participated in the Committee while 38 of them voted. However, the member amount of the 38 members  can not even reach half the total amount of the Committee. The election result was obviously reasonless and invalid.

We also noticed that according to the finance report of the institution of Tian jin love health group, the former Secretary of the China HIV/AIDS CBO Network , Wang Lixin, transferred 30,000 RMB to Wang Yong, the Consultant of the China HIV/AIDS CBO  Network and member of Research Center of the Chinese University of Hong Kong, which proved not really happening. The date of this finance settlement was 31st Dec,2013 while because of the canceling of the Wuhan conference, the training for Ms Wang Yong did not really carry out but the training fund was taken away by Wang Lixin. could it be a reasonable action? Wang Yong, as the consultant of the China HIV/AIDS CBO  Network, she never attended our regular meetings even by Internet.

We have no idea how she judges and assesses our work and also believe she may not be qualified for the consultant. As far as we got to know, many of the members' travel expense, like the fees for airplane and part of the accommodations, were not reimbursed totally as showed on the ticket while the finance report showed the absolutely different. Considering all the issues mentioned above, we strongly recommend that your Foundation (NED) should review and reassess the finance condition related to NED Supporting China HIV/AIDS CBO Network  Project of Tian Jin Love Health group from Oct to Dec,2013.

We have an alternative suggestion for you Foundation (NED): in term of the huge controversy and uncertainty of the new Secretariat, we are worried about the safety of the NED Supporting China HIV/AIDS  CBO  Network Project, we suggest temporarily stopping all the finance support for the China HIV/AIDS CBO Network from Jan to Sept, 2014. As for money laundering which the consultant ,who was hired by NED, attempted to do that under the cover of the China HIV/AIDS CBO Network, we recommend NED deselect Wang Yong of Research Center of Chinese University of Hong Kong as the the consultant and stop immediately the contract with her institution.

美国国家民主基金会：

    感谢贵机构多年来对联席会议的支持，我们需要对联席会议内部近期发生的一些事情向你们做出必要说明，希望你们能够了解到事情的真相。

2013年12月28日，武汉，新一届联席会议理事会在违反章程的前提下，采用不合程序以及不尊重章程的行为，错误的做出了选举新一任秘书处的决议，至今已有26家机构联名签署不承认新秘书处的选举结果，不认同河南公益先锋何胜楠为联席会议秘书长。

     根据章程规定，秘书处是通过成员大会选举产生，而理事会没有权利选举秘书处，联席会议之前的八届秘书处都是经过成员大会选举产生。

     同样，在武汉，理事会的选举也存在巨大争议，51个组织报道，38个组织参与理事会的选举，但是这38个组织不到成员组织数量的一半，武汉会议的理事会选举结果应该是无效的和不被承认的。

     我们还注意到，根据天津友爱家园递交的财务报告，联席会议原秘书长王立新给联席会议的顾问、香港中文大学公民社会研究中心王泳3万元项目款，但是这笔款项实际根本没有发生，王立新在这笔款项财务决算的日期是2013年12月31日，实际上因为武汉会议被迫取消的特殊原因，王泳的培训没有进行，但这笔款项被她领走了，不知道基金会是否认可上述行为？作为顾问的王泳，在2013年没有参加过一次我们例会（网络），不知道她是如何对我们的工作进行评估的，我们认为她不太适合继续担任联席会议的顾问。通过了解，许多成员组织乘坐飞机的费用和部分住宿费用均没有按照票面价格报销，而财务报告上体现出来的均是全额报销的。鉴于王立新上述的违规行为，我们建议基金会应该重新审核天津友爱家园2013年10月至12月期间涉及NED支持联席会议项目的财务状况。

     我们给基金会一个建议：鉴于联席会议新秘书处存在巨大争议和不确定性，我们担心NED支持联席会议的项目款存在安全隐患，我们建议NED暂时停止对联席会议2014年1月至2014年9月期间所有项目款项的资金拨款；鉴于NED聘用的顾问涉嫌通过联席会议洗钱的行为，我们建议NED取消香港中文大学公民社会研究中心王泳的顾问资格，终止和他们机构的合同关系。
